1. Acceptance of Terms

Welcome to Commute Snap. These Terms of Service ("Terms") constitute a legally binding agreement between you and Workflow Genie LLC, doing business as Code Bliss ("we," "us," or "our"), governing your access to and use of Commute Snap (the "Service").

By accessing or using Commute Snap, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years old to use Commute Snap. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

Commute Snap is a traffic camera alert service that delivers scheduled email notifications containing traffic camera images to help you make informed commute decisions. Our Service:

• Retrieves traffic camera images from the Ohio Department of Transportation (OHGO) public API
• Allows you to configure alerts with selected cameras and schedules
• Delivers camera snapshots via email at your specified times
• Is currently available for Ohio traffic cameras only

The Service is provided "as-is" without any guarantees of uptime, accuracy, or availability. Camera images, image quality, and delivery timing depend on factors outside our control, including OHGO API availability and email delivery.

3. User Accounts

3.1 Account Creation

To use Commute Snap, you must create an account by providing accurate and complete information, including:

• Your name
• A valid email address
• A secure password
• Your timezone

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information remains accurate and up-to-date

3.3 Account Restrictions

You may only create one account per person. Sharing account credentials or allowing others to access your account is prohibited.

4. Service Tiers and Pricing

4.1 Free Tier

The Free Tier is available at no cost and includes:

• 1 alert per day (alerts can be scheduled for different days of the week)
• Up to 3 cameras per alert
• Email delivery
• Access to all Ohio region cameras
• Flexible scheduling in 15-minute intervals

The Free Tier is provided free forever with no credit card required.

4.2 Express Tier (Coming Soon)

The Express Tier will be available for $5 per month and will include:

• Multiple alerts per day
• Up to 10 cameras per alert
• SMS notifications (when available)
• All Free Tier features
• Priority customer support

When the Express Tier becomes available, pricing and terms will be communicated before enrollment. Subscriptions can be cancelled at any time with no penalties.

4.3 Tier Limitations

We reserve the right to enforce tier limitations and may suspend or downgrade accounts that exceed their tier limits. Attempts to circumvent tier limitations (such as creating multiple accounts) are prohibited and may result in account termination.

5. Acceptable Use Policy

You agree to use Commute Snap only for lawful purposes and in accordance with these Terms.

5.1 Permitted Use

You may use the Service for personal, non-commercial purposes to receive traffic camera updates for commute planning and route decisions.

5.2 Prohibited Activities

You may not:

• Use the Service for any illegal purpose or in violation of any laws
• Engage in abusive, harassing, or fraudulent behavior
• Scrape, data mine, or use automated tools to access the Service without permission
• Share, sell, or transfer your account credentials
• Attempt to overwhelm our systems or disrupt the Service (DDoS attacks, etc.)
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent tier limitations or technical restrictions
• Resell or commercially exploit the Service without written permission
• Interfere with other users' access to the Service
• Impersonate others or misrepresent your affiliation
• Collect or harvest personal information from other users
• Use the Service to send spam or unsolicited communications

6. Third-Party Services and Content

Commute Snap relies on third-party services to provide traffic camera data:

6.1 Ohio DOT (OHGO)

Traffic camera images are retrieved from the Ohio Department of Transportation's public API (OHGO). We are not affiliated with, endorsed by, or officially connected with OHGO or the State of Ohio. Camera availability, image quality, and update frequency are controlled by OHGO and subject to their policies.

6.2 No Warranty for Third-Party Content

We are not responsible for:

• Camera outages or unavailability
• Image quality or accuracy
• OHGO service interruptions or changes
• Any third-party terms or policies

6.3 External Links

The Service may contain links to external websites or resources. We provide these links for your convenience but do not control or endorse their content. We are not responsible for the availability, accuracy, or content of external sites.

7. Intellectual Property

7.1 Our Property

The Commute Snap service, including its design, features, functionality, code, graphics, logos, and trademarks, is owned by Workflow Genie LLC and protected by copyright, trademark, and other intellectual property laws.

7.2 Camera Images

Traffic camera images are owned by the Ohio Department of Transportation. You receive these images under OHGO's public data policies. We do not claim ownership of camera images.

7.3 Your Data

You retain ownership of the personal information you provide to us (name, email, alert preferences). By using the Service, you grant us a limited license to use this information to provide the Service as described in our Privacy Policy.

7.4 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Commute Snap for personal, non-commercial purposes in accordance with these Terms. This license does not include any rights to:

• Resell or commercially exploit the Service
• Modify, copy, or create derivative works
• Reverse engineer or decompile any part of the Service
• Use the Service to develop competing products

8. Disclaimers and Limitations of Liability

8.1 Service Provided "AS-IS"

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Availability

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Traffic camera images will always be available or accurate
• Email alerts will be delivered on time or at all
• The Service will meet your specific requirements
• Any errors or defects will be corrected

8.3 Not a Substitute for Direct Observation

Traffic camera images are for informational purposes only and should not be used as a substitute for:

• Direct observation of road conditions
• Official traffic reports and advisories
• Weather forecasts and alerts
• Safe driving practices and judgment

Always exercise caution and good judgment when driving. We are not responsible for any accidents, delays, or incidents that occur while using our Service.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKFLOW GENIE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on the Service
• Traffic accidents, delays, or route decisions made based on camera images
• Unauthorized access to your account or personal information
• Interruptions or errors in the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS, OR $100, WHICHEVER IS GREATER. FOR FREE TIER USERS, OUR MAXIMUM LIABILITY IS $100.

8.5 State-Specific Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Workflow Genie LLC, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any content or information you provide through the Service

10. Service Modifications and Termination

10.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time
• Change features, functionality, or tier limitations
• Add or remove supported regions or cameras

We will make reasonable efforts to notify you of significant changes that materially affect your use of the Service.

10.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your account is inactive for an extended period
• We are required to do so by law
• Providing the Service to you is no longer commercially viable

10.3 Termination by You

You may cancel your account at any time through your account settings. Upon cancellation:

• Your account and all associated data will be permanently deleted within 30 days
• You will no longer receive alert emails
• If you have a paid subscription, it will be cancelled (no partial refunds unless required by law)

10.4 Effect of Termination

Upon termination of your account:

• Your license to use the Service immediately terminates
• We will delete your personal data as described in our Privacy Policy
• Sections of these Terms that by their nature should survive (disclaimers, limitations of liability, indemnification, governing law) will continue to apply

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. When we make changes:

• We will update the "Effective Date" at the top of these Terms
• For material changes, we will notify you via email or through a notice on the Service
• You will have 30 days from the notification to object to the changes

Your continued use of Commute Snap after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of such courts.

12.3 Informal Resolution

Before filing any legal claim, you agree to first contact us at support@workflowgenie.com to attempt to resolve the dispute informally. We will work in good faith to resolve any issues.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Workflow Genie LLC regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms and your account to any affiliate or in connection with a merger, acquisition, or sale of assets.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet service disruptions.
